INFORMATION CONCERNING PERSONAL DATA – update of the requirements adapting RADWAG WAGI ELEKTRONICZNE to the requirements of modified regulation on the protection of personal data hereinafter referred to as 'RODO'
We would like to inform that RADWAG WAGI ELEKTRONICZNE Witold Lewandowski with its registered office in Radom (26-600), Toruńska 5 Street, hereinafter referred to as RADWAG,is the exclusive Controller of your personal data.
It should be noted that all personal data that has been or will be provided to us is used only for the purposes of RADWAG business activity.
Thereby RADWAG takes responsibility for the use of personal data in a safe and legal manner that complies with the agreement or other arrangements between the parties, and is compliant with the legal regulations in force in this respect binding in Poland.
Personal data will be processed by RADWAG, in particular:
§1. On the Basis of Article 6 of RODO In Order To
Take actions, prior to conclusion of an agreement or execution of the agreement, on a request of a person who is a party or a data subject of the agreement (the data crucial for the conclusion of the agreement is listed in the agreement form; the provision of the personal data is indispensable from the point of view of legal certainty to determine obligations of the parties)
Comply with a legal obligation to which the Controller is subject
§2. On the Basis of Legally Justified Interest of RADWAG, i.e. On the Basis of Article 6, Paragraph 1, f Letter of RODO In Order To:
Perform marketing actions of proprietary products and services, including those customized according to customer's profile
Prepare dedicated commercial offers on the basis of previously reported demand
Organize and conduct competitions and other marketing campaigns related to RADWAG business activity
Organize meetings, technical and scientific seminars, lectures and readings
Pursue or secure financial claims for unpaid invoices, agreements
Carry out service quality assessment in the scope of delivered products and services
Carry out recruitment of the candidates for the vacancies
Carry out legal obligations, i.e.:
issuing, sending and storing copies of invoices and other accounting documents crucial to fulfil tax obligation
issuing order confirmation or other document related to the execution of orders
organizing transports and deliveries
answering to complaints within the time and form determined by the law
§3 Data Required for Fulfilment of Legal Obligations Will Be Used:
Throughout the duration of the obligations, e.g. issuing invoices, confirmations, responses to letters and correspondence relating to current business activity
Throughout the time required by the law to store the data, e.g. tax, administrative and other that may affect the legal status and safety of the company
Throughout the time when RADWAG may face legal consequences in case of non-performance of legal and tax obligations
Throughout the duration of the agreement and the time after which claims, resulting from the customer-RADWAG agreement, expire; in the case of pursuing claims or notifying competent bodies, throughout the duration of such actions, including collection proceedings
Arrangements, defendences and pursue of claims which may include sale of RADWAG receivables to another subject - throughout the time after which all claims, resulting from the agreement, expire
In order to prepare comparisons, statistical analysis for internal needs of the company, including reports, marketing research, service development plans, IT development - throughout the duration of the agreement and after termination of the agreement for not longer than for the period after which all claims, resulting from the agreement, expire
Verification of customer creditworthiness - throughout the time required for carrying out of such verification when concluding, prolonging or extending this or another agreement, and to consider related complaints
§4 Data Processing Period
Personal data processed in order to conclude or perform an agreement, and for Controller's compliance with legal obligation, will be stored throughout the entire term of the agreement, and after that term for the time crucial for:
Post-sale customer support (considering complaints)
Post-sale service (devices repair)
Information actions concerning free and paid upgrades of purchased products
Information concerning service actions
Securing or pursuing possible claims payable to RADWAG
Performing legal obligations by the Controller (e.g. resulting from tax or accounting regulations)
Personal data processed for the purpose of marketing of proprietary products and services, on the basis of legitimate interest, will be processed until the data subject submits objections
Personal data processed on the basis of separate consent will be stored until the consent withdrawal.
§5 Data Subject Rights
The right to access the content of the data subject's personal data, i.e. the right to obtain confirmation whether the Controller processes the data, and information regarding the processing itself
The right to modify the data, if the data processed by the Controller is incorrect or incomplete
The right to request the Controller to erase personal data
The right to request the Controller to limit the processing of personal data
The right to transfer the data, i.e. the right to obtain processed data from the Controller and to send the data to other administrator
The right to object to the processing of personal data on the basis of Controller's legitimate interest, or to the processing of personal data for the purpose of direct marketing
The right to lodge a complaint to the Polish supervisory body or a supervisory body of other country being a member of the European Union, competent with respect to the place of habitual residence or work of the data subject, or competent with respect to presumed RODO infringement
The right to withdraw the consent at any time (without affecting the legality of processing carried out on the basis of the consent prior to its withdrawal)
The right to obtain human intervention on the part of the Administrator and the possibility for the data subject to express his or her point of view and to contest the decision of automatic processing of personal data
The right to be forgotten, i.e. the right to erase all personal data of the data subject who requests all RADWAG ICT systems with such a demand
